These Terms and Conditions (“Agreement”) govern the relationship between you (“Driver” or “Delivery Partner”) and Feres Transport Market Place (Feresegna) regarding the use of the Feresegna App mobile application (“App”) to provide delivery services. By registering as a Driver, you agree to comply with these Terms and the Privacy Policy.

1. Eligibility

• You must be at least older than the legal driving age in Ethiopia.
• You must possess a valid government-issued ID, driver’s license (if using a motor vehicle), and any permits required by Ethiopian law.
• You must have an eligible vehicle (bike, scooter, motorbike, or car) that meets safety standards.
• You must pass background checks as required by law and/or company policy.

2. Independent Contractor Relationship

• Drivers are independent contractors, not employees of the Company.
• Nothing in this Agreement shall be construed as creating an employment, agency, or joint venture relationship.
• Drivers are solely responsible for their taxes, insurance, and compliance with Ethiopian laws.

3. Use of the App

• You agree to use the App only for lawful purposes and to accept, pick up, and deliver orders promptly.
• You must not misuse the App (e.g., fraudulent activity, manipulating location/GPS, sharing accounts).
• The Company may track your location during deliveries for customer service and safety purposes.

4. Delivery Responsibilities

• Accepting a delivery order constitutes a binding agreement to complete the delivery.
• You must handle food and goods with care and follow hygiene standards.
• You must comply with traffic rules, safety regulations, and delivery laws of Ethiopia.
• You must not engage in unsafe driving, reckless behavior, or harassment of customers/merchants.

5. Payments & Fees

• Drivers will receive payment per completed delivery, as shown in the App.
• The Company may deduct service fees or commissions from each delivery.
• Payments are processed weekly (or as otherwise stated in the App).
• Any bonuses or incentives will be subject to separate terms.

6. Taxes & Insurance

• Drivers are solely responsible for declaring and paying applicable taxes.
• You must maintain valid vehicle insurance, health insurance, and any other coverage required by law.
• The Company is not liable for accidents, damages, or injuries that occur while providing services.

7. Ratings & Reviews

• Customers may rate and review Drivers after deliveries.
• Consistently low ratings or complaints may lead to suspension or deactivation.
• You agree not to manipulate ratings or pressure customers for positive feedback.

8. Prohibited Conduct

Drivers may not:

• Use drugs, alcohol, or unsafe substances while delivering.
• Commit theft, fraud, or harassment against customers, merchants, or staff.
• Share their account or let unauthorized persons use the App.
• Carry illegal items, weapons, or unapproved goods.

9. Termination & Suspension

• The Company may suspend or deactivate your account immediately for violations of these Terms.
• Drivers may terminate their account at any time by notifying the Company.
• Pending payments will be settled upon termination, subject to deductions.

10. Liability & Indemnity

• The Company is not liable for accidents, losses, or damages caused by the Driver.
• You agree to indemnify and hold harmless the Company against any claims, damages, or expenses arising from your actions while providing services.

11. Intellectual Property

• The App, logo, and related content are the property of the Company.
• You may not copy, distribute, or modify the App without written consent.

12. Changes to Terms

• The Company may update these Terms from time to time.
• Continued use of the App after changes indicates acceptance of the updated Terms.

13. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the Federal Democratic Republic of Ethiopia.
• Disputes shall be resolved through arbitration or Ethiopian courts, as applicable.

14. Privacy Policy & Data Usage

• We collect and use personal information such as name, phone number, email, and payment details to operate the App.
• We access and use Location Data to enable real-time delivery tracking, navigation, and proof of delivery.
• Location access is only active when a delivery is in progress and stops once the delivery is completed.
• We do not sell or share personal data with third parties except as required to provide services (maps, payment processing, navigation).
• Data is securely stored and handled according to applicable Ethiopian laws and international standards.
